Hi everybody,

I have an impending divorce so i was worried for children as to whom will they stay with.Is it possible for the child to have any say in the custody decision.

Yes Hanks, they do have a say but only if the children are of older age then the courts might sometimes listen to their wishes , but the preference of the child is not binding on the court. Very rarely does the court listen to younger children..

How old are your children Hanks.. You can talk to your lawyer and take his advise too.

I live in NJ. Iwas able to voice my preference when I was 13. My daughter is 4 and she is too young to voice her preference. Find out the laws of your state.

Well I never have found such example but am very sure that if ur children havn't grown up to the mature age, court either don’t listen to them or listen but there words do not carry much value.
Please contact ur personal Lawyer for more detailed info...he may give u some good helping info

MIne is 13 the older one and its very hard he is brainwashing him to kive with him I just hope the courts do whats right and do not seperate my children it would kill them...its hard ...the women dont get the children as they once did...

it depends of their age ... but they have the right to say something or else its not fair... They have the right to be happy!!!!!!!!
