Hello Everybody,
My sister has applied for divorce. There are some disputes between my sis and her spouse. I don’t know exactly but both of them are responsible for the rift in the relationship.
Could anyone tell me what happens when both parties are ‘at-fault’ in a divorce?
I wanna know court will favour whom in this type of situation where both the spouse are guity.
I will appreciate any information from u guys.

Default If both parties are ‘at-fault’ in a divorce
In a disputed case of Divorce, when the spouse are 'at fault', for example adultery and desertion, the spouse with the higher or strong reason for divorce, In the court adultery may be help or head on the divorce.

Will the division of property and potential spousal support be affected by whether or not I obtain a fault or no-fault divorce?

In this the attorney is vital to represent your best interests in the division of property in the dissolution of a marriage. In some states the court can consider the spouses' faults in deciding how to distribute property and provide spousal support. In a no fault divorce situation, the actions of the respective spouses in the breakdown of the marriage do not affect property distribution or spousal support rights.

Default Custody of children
Hi Everybody,
I myself is a example of such type of case where divorce happens because of both husband and wife.
I think it is our ego which causes rift in our relationship. Neither i nor my spouse was ready to sacrifice our ego and as a result today we atre in the verge of divorce.
We have a 1 year old som and i want to know who will get the custody of children when both parents are at fault ?
If anyone of u have any idea regarding it pleez let me know.
