Hi everybody! After spending a 6 years of happy married life both of us have decided to be apart and take divorce. Although both of us have decided this and we have settled everything, but I fear that my spouse will not sign the agreement.
Could anyone tell me what I will do if she refuses to sign the agreement?
I will remain thankful for any suggestion from any one of u. I am really tensed. Please help me.

Hi Andrew,
Although I think that she will sign the agreement and your fear is baseless but if she refuses to sign then u can go to court for justice. Firstly the court will orders both of you to solve the problem by mediation. If an agreement is reached in mediation, the court can enter a final order based on the terms of the mediated settlement agreement between u and your wife for the divorce. If not, then you are on the court's docket for trial.

Hi Andrew,
I am agreeing with fatema. But just inform your spouse that it will be in her interest to sign agreement if she denied signing it. If the case will reach court then I am sure that u will be the winner. So don't bother about it. Anyway I too think that your fear is baseless.

Hi Everybody,
In my opinion Andrew's fear is not baseless as there are several cases in which spouse refuse to sign the agreement after all the settlement has been made. Few years’ back my brother had faced the same problem when his wife refuses to sign the agreement and demanded a handsome amount of money to sign it. After that my brother goes to court and the whole issue was solved by court.

Ya Pride,
I am agree with u. There are several cases in which one of the partner refuses to sign the agreement after all the settlement's has been made so hat he/she will gain something from further negoiation. Well certainly he/she can be taken to court for not signing the agreement, even though if all is settled between you both, since signing is a must if all is settled.
