Hello James, There are lot of issue that u have to solve in order to get divorce from your spouse. You have to solve problems like child support, visitation schedule for the child, property division and possibly a name change.

If u and your spouse both are ready for out-of-court-settlement then its ok otherwise you have to go to court for trial. After that only you can get divorce.

In most cases one has to knock the door of court for Divorce. My brother and his wife become apart but after along legal battle. Both of them are not agree on several issues including custody of their 6 year's old daughter. Court has sent her in the joint custody.
