Usually, the obligation to pay maintenance by the spouse will be enforced by the courts, and upon the application of the recipient spouse, the court may enter a judgment against the non-paying spouse. Therefore, if the obligation to pay maintenance takes place out of a separation agreement, the court may treat the failure to pay as a breach of contract and might also award interest at nine percent. Thus, A court may also award attorneys fees to the recipient spouse. :cool:

Hi Veronica,
As u have mentioned that your spouse is not paying the maintenance that court have ordered him, I will suggest u to complain regarding it in court. Court will not only force him to pay the maintenance but he also have to pay penalty for defying court order. I hope that everything will be alright for u.
