Hi All!
One of my friends who was married 2 years back want to be separated from his spouse. His spouse too wants to be apart from him. But instead of divorce they have preferred legal sepration. What could be the reason for a couple to go in for a legal separation instead of a divorce?

Many times, some couples have pious reasons for not wanting a divorce. Thus, adding to this, in some no-fault states, a legal separation is grounds for a divorce. Therefore, if the couple lives apart in a legal separation for a particular time period that has been set by state law such as in New Jersey it is 18 Months, then either the husband or the wife can file for divorce under no fault grounds. But, if the couple in this situation does not have a legal separation, then it is possible that the husband or the wife would have to file under some other type of grounds, which is almost always placing marital fault. :(

Ya i too agree with u Sally. Legal sepration is very useful in some cases. I have witnessed few cases where couples preffer legal sickness over divorce.
Thanx for such good information. It will help Jamie and other people too.
I will suggest him to consult lawyer for further information.
